Terms and conditions of sale


ARTICLE 1 - PRICE

1.1 - The prices of our products are shown in Euros including VAT but excluding handling and shipping costs. (See delivery section). 1.2 - All orders regardless of origin are payable in Euros. 1.3 - Nomadeshop.com reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates applicable at the time of registering orders subject to availability on this date. 1.4 - Retention of title clause. The products remain the property of Nomadeshop.com until complete payment of the price by Nomadeshop.com.


ARTICLE 2 - ORDER

Online: http://www.nomadeshop.com contractual information is presented in the French language and will be subject to confirmation containing this contractual information no later than the time of delivery. Nomadeshop.com reserves the right to cancel any order from a customer with whom there might be a dispute relating to the payment of a previous order.


ARTICLE 3 - CONFIRMATION

When you click on the button "Confirm" after the ordering process, you accept this as well as all these terms and conditions of sale, in full and without reserve. The details saved by Nomadeshop.com constitute proof for all transactions processed by Nomadeshop.com and its customers.


ARTICLE 4 - AVAILABILITY

Our products are sold according to available stock. For products not stored in our warehouses, our products are valid subject to availability at our suppliers. In this context, indications on the availability of products are sent to you by email. This information comes directly from our suppliers, and we therefore cannot be held responsible for any errors or exceptional modifications, which are outside of our control. If any products are unavailable after placing your order we will inform you by email or by post as soon as possible. You can then request to cancel or exchange your order by clicking on the link "contact us" which you will find at the bottom of the Nomadeshop.com website.


ARTICLE 5 - DELIVERY

5.1 General points. Products purchased on Nomadeshop.com are delivered all over the world. The products are delivered to the delivery address that you specify during the ordering process. The delivery times shown are the average times and correspond to handling and delivery times. In the case of items delivered on different dates, taking into account their availability, the delivery time shall be based on the longest time. Nomadeshop.com, however, reserves the right to split deliveries. Only shipped products will then debited. Handling and shipping costs will only apply for a single shipment. Nomadeshop.com cannot be held responsible for consequences due to any delay in delivery. Any order not shipped within 30 days of the order will be cancelled. 5.2 - Delivery problems. You must check the conformity of the goods delivered at the time of delivery and before signing the delivery note, and indicate any anomalies concerning the delivery in the form of handwritten reservations on the delivery note accompanied by your signature (anomaly, damaged product). You will also need to confirm any reservations you have by clicking on the link "contact us" that you will find at the bottom of the Nomadeshop.com website no later that two working days following receipt of the item or items. If the products need to be returned to us, they must be delivered to us within two working days following the delivery date. Any claim made outside of this time limit will not be accepted. Product returns will only be accepted for products in their original condition (packaging, accessories, instructions). 5.3 - Conformity and quality. We commit to refunding you or exchanging any products that do not correspond to your order (defective or non-compliant). You must let us know of any claims concerning products that do not conform to your order (delivery error, non-compliance of products) by clicking on the link "contact us" that you will find at the bottom of the Nomadeshop.com website, on the delivery date or at the latest within two working days following the delivery. On your claims you must indicate the purchaser's contact details, the order number, product references and the reasons for your claim. Any claim made outside of this time limit will not be accepted. Nomadeshop.com will carry out an exchange or refund of the products. Products may only be returned in the case of a product error only for complete products, in their original conditions (packaging, accessories, instructions…) with a copy of the invoice. Products returned in the event of a defect or non-compliance will only be accepted for products in their original condition (packaging, accessories, instructions…). In the cases referred to in Article 5.2 and 5.3, the shipping and return costs will be refunded to you. However, the amount refunded for return costs may not exceed 1.5 times the shipping costs charged .


ARTICLE 6 - PAYMENT 

Payment for your purchases can be made out by credit card, Paypal or cheque (payment in several instalments).
 
In the case of payment by bank card: the card will be debited as soon as the order is confirmed.

NOMADESHOP offers you the option of paying in 3 instalments without charge, for purchases worth €150.00 or more (one hundred and fifty euros).
In this case, send three cheques dated the same day, of an equal amount, payable to "NOMADESHOP", at the following address:

Please attach a copy of your purchase order, as well as a copy of a valid ID card or passport.
The first cheque will be banked upon receipt and each of the other two at monthly intervals.


ARTICLE 7: SECURITY

Our website is protected by a security system: We use the SSL encryption process but have also strengthened all of our jamming and encryption processes to protect all sensitive data relating to payment methods as effectively as possible. In addition to our bank's security service, we also work with the the payment security organisation "PAYBOX", which adds a second level of security for payments by Carte Bleue. You can also choose to pay via "Paypal". We would like to inform you that information related to your order may be subject to verification by the certification body Certissim of the company FIA-NET SA. This body checks more than 20 million transactions each year on behalf of several thousand websites. The purpose of this process to to provide a level of analysis for transactions and to fight against bank card fraud. It takes into account several dozen different criteria in order to validate the consistency of the order. Within the framework of its order-monitoring service, the company FIA-NET SA may contact you by phone or email in order to verify the transaction. They may, if necessary, ask you for supporting documents (piece of ID or proof of your bank details (RIB)). You can find more information at: www.certissim.com. You have the freedom to respond favourably or unfavourably to requests by this body. Unfortunately, given the numerous "attempts" at fraud that we experience on a daily basis, we will not be able to honour your order. In this case, simply send us an email to service.clients@nomadeshop.com, requesting a refund of your order. This will be processed within seven working days. Don't forget to clarify your last name, first name and order number. Of course, in accordance with the "loi informatique et libertés" (French data protection act) of 6 January 1978, you have the right, at any time, to access, correct or oppose any of your personal data by writing, by post, and providing proof of ID, to FIA-NET/Certissim - Service Informatique et Libertés – 39 rue Saint Lazare – 75009 Paris.


ARTICLE 8 - SATISFACTION OR MONEY BACK

8.1 - You have a period of 14 days from the date of receipt to return any product that doesn't suit you. Shipping and return costs will then be payable by you. Only the price of the product or products purchased will be refunded. However, for a product that considered non-compliant with the order, the return costs will be payable by Nomadeshop and therefore reimbursed. This right of return will only be accepted for complete products, in their original condition (packaging, accessories, instructions) with a copy of the invoice. Articles returned incomplete, damaged or dirtied by the customer will not be accepted. 8.3 - We commit to reimbursing you within a period less than or equal to 10 days following receipt of products by us. The reimbursement will be made upon the choice of Nomadeshop.com by credit to your bank account or by cheque made payable to the name of the customer who placed the order and sent to the billing address. 8.4 - Exception made for the custom products such as the custom maker. In accordance with the terms of Article L.121-20-2 of the French Consumer Code, the right of withdrawal is not applicable to items supplied based on the customer's specification or those significantly customised or which due to their nature cannot be re-shipped. 8.5 - No alternative products will be shipped instead of a refund for any reason whatsoever.

ARTICLE 10 - INTELLECTUAL PROPERTY

10.1 - All texts, comments, works, illustrations and images reproduced on the Nomadeshop.com website are protected by copyright law as well as intellectual property law, including for the whole world. As such and in accordance with the provisions of the Intellectual Property Code, only private use is authorised subject to different provisions even more restrictive than the intellectual property code. Any other use constitutes infringement and is punishable under Intellectual Property law unless prior authorisation is granted by Nomadeshop.com. Any total or partial reproduction of the Nomadeshop.com catalogue is strictly prohibited.


ARTICLE 11 - RESPONSIBILITY

The products offered comply with the French legislation in force and the standards applicable in France. Photographs, texts, infographics and features reproduced, and which illustrate the products on offer are for illustrative purposes only. Accordingly, Nomadeshop.com cannot be held liable in case of an error or omission in one of these photographs, texts or infographics or features of the products or in the event of a change in the characteristics of the products by the suppliers. Of course, for any questions on the products, you can contact our customer service team (by clicking on the link "contact us" that you will find at the bottom of the Nomadeshop.com website). Nomadeshop.com cannot be held liable for breach of contract in the case of stock-outs or product unavailability, force majeure, disruption or total or partial strike of the postal services and means of transport and/or communications, flood or fire. Nomadeshop.com will not be held liable in any way whatsoever for any damages resulting from these terms and conditions, operating losses, loss of profit, loss of opportunity, damages or expenses which may arise from the purchase of the products. We remind you that it is prudent to proceed with a backup of the data contained in the products purchased. Nomadeshop.com cannot be held liable for any loss of data, files or for damages defined in the previous paragraph. The total or partial inability to use the products, particularly because of the incompatibility of the equipment, cannot give rise to any compensation or reimbursement or incur the liability Nomadeshop.com. Hypertext links may refer to websites other than the Nomadeshop.com website. Nomadeshop.com assumes no liability in the event that the content of these websites would contravene the legal and regulatory provisions in force. Our products perform in line with professional use even if the intent of the Nomadeshop.com is not to sell to professionals. Nomadeshop.com therefore cannot be held liable for any injury whatsoever resulting from professional activity.


ARTICLE 12 WARRANTY

All our products are guaranteed for 1 (one) year, except items dedicated to any "freestyle" or "aggressive" practices which are guaranteed for 3 (three) months, (freestyle scooters, freestyle and aggressive skates).
The warranty applies in cases of proven non-conformity defects affecting the delivered product, or resulting from non-compliant packaging, or even inadequate assembly instructions.
The purchaser may, in this case, request the repair or replacement of the product ((Art.L211-1 to the212-1 of the Consumer Code).

The warranty also covers hidden defects making the product sold unfit for a good use.
The purchaser may, in this case, claim a partial or full refund of the product (art.1641 to 1649 of the Civil Code).

To be able to benefit from the warranty, it is essential to retain the product's purchase invoice and contact our after-sales service by clicking on the "contact us" link that you can find at the bottom of the Nomadeshop.com website page .

Exclusions: The warranty does not cover:
- The replacement of consumables,
- Abnormal or non-compliant use of the products, especially those used intensively (Activities such as "freestyle " and "aggressive" or in skateparks).
In this regard, we invite you to carefully read the instructions provided with the products, (consequences related to produce usage that does not comply with the usage for which the product is intended).


ARTICLE 13 - APPLICABLE LAW - DISPUTES

This contract is subject to French law. The language of this contract is the French language. In the case of a dispute. the courts of Paris (France) will have authority.h2 style="font-size:x-large">

Nomadeshop.com undertakes not to disclose to third parties the information that you communicate to us. This information is confidential. They will only be used by its internal departments for processing your order and to strengthen and personalise communications and the cultural and product offer reserved for Nomadeshop.com customer, including Nomadeshop.com newsletters to which you subscribe as well as in the framework of website personalisation according to your areas of interest. However, when you visit Nomadeshop.com from partner sites of Nomadeshop.com, and identified as such, the details concerning you are likely to be communicated to third parties in these exceptional cases. If you do not want this to happen, please let us know at the addresses below. This article cannot prevent the sale or transfer of activities to a third party. ARTICLE 15 – THE "SITE ÉVALUÉ - SITE PREMIUM’' OPERATION  

Your purchase on Nomadeshop.com gives you the chance to take part in the operation "site évalué – site premium" organised by FIA-NET S.A.
through two satisfaction questionnaires, the purpose of which is to measure the quality of service that you have received throughout the purchase process. You’ll be able to share of your personal experience with us and the community of web users on the FIA-NET website.
These questionnaires may be sent to you by FIA-NET or by Nomadeshop.com via email following your purchase.
The information gathered in these two questionnaires is subject to automated data processing under the responsibility of FIA-NET S.A.
Partial answers or a lack of response to either of the satisfaction questionnaires will not have any impact on the progress and handling of your order.
FIA-NET S.A. and Nomadeshop.com are the recipients of the personal data collected in these satisfaction questionnaires.
