Nomadeshop.com General Conditions of Sale


ARTICLE 1 - PRICES

1.1 - The prices of our products are shown in Euros inclusive of all taxes but excluding the cost of postage and packing. (see Delivery notes) 1.2 - All orders irrespective of origin will be payable in Euros. 1.3 Nomadeshop.com reserves the right to modify its prices at any time; items will be charged according to the active tariffs at the moment of ordering subject to their availability at that time. 1.4 - Property ownership: Items will remain the property of Nomadeshop.com until payment is received for them by Nomadeshop.com.

ARTICLE 2 - ORDERING

Online: http://www.nomadeshop.com Contractual information is presented in French. It will be confirmed along with all contractual information no later than the time of delivery. Nomadeshop.com reserves the right to cancel any order from a client from whom there is a previously unpaid order under dispute.

ARTICLE 3 - VALIDATION

When you click the Confirm" button after proceeding through the ordering process, you declare that you fully and without reservation accept these General Conditions of Sale. Data held by Nomadeshop.com will constitute proof of transactions occurring between Nomadeshop.com and customers.

ARTICLE 4 - AVAILABILITY

Our products are offered for sale according to the amount of stock we have available. For products not stocked in our warehouse, our offers are valid depending on the availability of the product from our suppliers. In these cases, information on product availability will be sent to you by email. These communications come directly from our suppliers, and we cannot be held responsible for any errors or exceptional alterations as these are outside of our control. In the case that the product is unavailable once your order is received we undertake to inform you by email or mail as fast as possible. You may then request to cancel or amend your order by clicking on the "Contact us" link at the bottom of the page on Nomadeshop.com

ARTICLE 5 - DELIVERY

5.1 General remarks Items purchased via Nomadeshop.com can be shipped internationally. Items are shipped to the delivery address entered during the order process. Indicated shipping times are averages only and correspond to expected times for packing and shipping the order. For items delivered on different dates due to different availabilities, the delivery window is based on the longest delay. Nomadeshop.com reserves the possibility to split an order into several separate deliveries. Only products already shipped will be charged to you. Postage and packing fees will only be charged for a single shipment. Nomadeshop.com cannot be held responsible for the consequences of a delayed shipping. Any orders not shipped within 30 days of the date of ordering will be cancelled. 5.2 - Delivery problems You are responsible for verifying the condition of your items at the moment of delivery before signing the delivery receipt, and noting any problems with the delivery (error, damaged product...) on the delivery receipt and also in the form of a signed written record. You must also confirm these details by clicking on the "Contact us" link at the bottom of the Nomadeshop.com webpage not later than two working days from the delivery of the items. Any products requiring to be returned to us should be sent within two days for the date of delivery. Any return requests later than this will not be accepted. Returned items will only be accepted if in their original condition (packaging, accessories, labels). 5.3 - Suitability or quality We undertake to refund or exchange items which do not correspond to your order (defective or unsuitable). You must contact us by clicking on the "contact us" link at the bottom of the Nomadeshop.com webpage not later than two working days from the date of delivery for any refund concerning products which do not correspond to your order (delivered in error, unsuitable...). Your claim must include the purchaser details, your order number, the product reference and the reasons for your claim. Any return requests later than this will not be accepted. Nomadeshop.com will exchange or refund you for your purchase(s). Product returns in the case of error will only be accepted for entire items still in the state in which they were sold (packaging, accessories, packing slip) along with a copy of the proof of purchase. Product returns due to defects or unsuitability will only be accepted for items still in the state in which they were sold (packaging, accessories, labels). In the situations described in articles 5.2 and 5.3, delivery and return costs will be refunded. The amount refunded for return costs will not be greater than 1.5 times the original cost of delivery charged to you.

ARTICLE 6 - PAYMENT

Purchases can be paid for by credit/debit card or personal cheque. For credit or debit cards, payment is taken at the time of ordering. For cheques, payment is taken when the purchase is shipped, following receipt of the cheque. The costs of sending the cheque to Nomadeshop are to be borne by the customer.

ARTICLE 7: SECURITY

Our site is security-protected. We use SSL encryption with reinforced scrambling and encryption processes in order to most effectively protect sensitive data linked to methods of payment.

ARTICLE 8 - SATISFACTION OR REFUND

8.1 - There is a 7 day window after receiving your order in which you can return it for whatever reason. Delivery charges for returns are the responsibility of the customer. Only the price of the products(s) purchased will be refunded. However, in the case of packages which are returned without being opened, we will refund both the price of the product(s) purchased and the relevant delivery charge(s). This right of return will only be accepted for entire items still in the state in which they were sold (packaging, accessories, packing slip) along with a copy of the proof of purchase. Items returned by the Customer in an incomplete, damaged, broken or soiled state will not be refunded. 8.3 - We agree to reimburse you within 7 of receipt of the returned items. Reimbursement will be via your credit or debit card or via a personal cheque at the discretion of Nomadeshop.com. In the case of a cheque, it will be addressed to the customer name on the order sent to the billing address. 8.4 - Any shipment without an agreed refund for whatever reason will not be accepted.

ARTICLE 9 - CUSTOMER SERVICE

ARTICLE 10 - INTELLECTUAL PROPERTY

10.1 - All text, comments, works, illustrations and images reproduced on the Nomadeshop.com site are internationally reserved under copyright and intellectual property laws. For this reasons, and in conformity to the Intellectual Property Code, only private usage is permitted, subject to the more restrictive provisions of the Intellectual Property Code. Any other use without the authorisation of Nomadeshop.com is in breach of the articles of the Intellectual Property Code and open to legal sanction. Any copying of the Nomadeshop catalogue - whether partial or total - is expressly prohibited.

ARTICLE 11 - RESPONSIBILITY

The items offered conform to currently-applicable French legislation and manufacturing standards. Image, text, graphic information and product specifications illustrating the products available are for information only. As a result, Nomadeshop.com cannot accept any responsibility arising from an error or omission in these images, texts, graphic information or product specifications for the products or in the case of modification of the product specifications by our suppliers. Nomadeshop.com cannot be held responsible for breach of contract in the case of stock shortage or unavailability, force majeure, disruption or partial or total strike activity within the postal, transport and/or communications services, flooding or fire. Nomadeshop.com shall not be held liable for any indirect loss due to the following: operating loss, loss of profit, loss of opportunity, damages or expenses that may arise from the purchase of these products. You are particularly reminded to backup data contained in products that you purchase. Nomadeshop.com cannot be held responsible for any loss of data, files or any damaged defined in the preceding paragraph. A partial or total inability to use the products in particular arising from a hardware incompatibility shall not give rise to any compensation, refund or admission of responsibility by Nomadeshop.com Hypertext links on this site make take you to sites outside of the Nomadeshop.com domain. Nomadeshop.com is not responsible for the content of any external sites. The products sold by Nomadeshop are of a standard suitable for professional use, although Nomadeshop does not undertake to sell to professionals. As a result Nomadeshop.com cannot be held responsible for any loss or damage no matter how incurred, as a result of professional activity.

ARTICLE 12 - GUARANTEE

Items bought via the Nomadeshop.com site come with the guarantee specified on the product information page on the website. In any case you have a legal warranty against hidden defects. For information on the correct procedure to follow regarding after-sales support for any problem or fault in a product, please link on the "Contact us" link on the bottom of the Nomadeshop.com webpage. You must keep the proof of purchase of the item to make use of the guarantee. The guarantees do not cover: - replacement of consumable parts (wheels, bearings...) - abnormal or unsuitable use of the items. We particularly invite you to pay careful attention to the instructions for use accompanying the items. - defects and consequences thereof arising from a usage for which the product is unsuitable (professional or group use...). - defects and any consequences thereof arising from any external cause.

ARTICLE 13 - APPLICABLE LAW- DISPUTES

This contract is made under French law. This contract is originally presented in French. Any legal proceedings shall occur within the jurisdiction of the court in Paris (France).

ARTICLE 14 - PERSONAL INFORMATION

Nomadeshop.com will not disclose information you provide to us to third parties. These are confidential. They will be used by our internal services only to fulfil your order and to enhance and personalise the communications, lifestyle information and special products offered to customers, particularly by Nomadeshop.com newsletters to which you are subscribed, as well as to customise the site according to your personal preferences. However, when you visit Nomadeshop.com from certain identified Nomadeshop.com partner sites, information concerning you may in exception circumstances be passed to third parties. If you do want us to do this, please let us know via the addresses below. This Article shall not prevent the sale or transfer of activities to a third party.
